RESUMO: O objeto deste artigo é a noção de pós-modernismo, em torno da qual se travou um amplo debate que, num passado recente, alcançou grande projeção, e arrefeceu de modo algo abrupto. Buscaremos demonstrar que uma consideração crítica acerca do referido debate amplia nossa compreensão a propósito do capitalismo contemporâneo e, nesse sentido, por um lado, será realizado um esforço de apreensão conceitual, com o intuito de fixar as principais determinações do pós-modernismo. Por outro lado, tentaremos ancorar historicamente o debate (...) sobre o pós-modernismo, localizando certas articulações entre o desenvolvimento teórico e o processo histórico que lhe é subjacente. ABSTRACT: The object of this article is the notion of postmodernism, a topic around which was established a wide-ranging debate that achieved wide publicity in the fairly recent past. This debate, however, has since cooled abruptly. We will seek to demonstrate that a critical consideration of this debate enhances our understanding of contemporary capitalism. We first make an effort at conceptual apprehension, in order to establish the main determinations of postmodernism. Um dos problemas a serem superados pelos defensores de uma IA forte é o argumento do quarto chinês de J. Searle. Este artigo propôs-se a analisar se o argumento estruturado no experimento de pensamento do quarto chinês foi refutado pelo modelo de superinteligência. Analisamos o modelo de N. Bostrom e o argumento de S. Bringsjord e verificamos não serem eles suficientes para rejeitar qualquer premissa do argumento de Searle.

BackgroundBased on an actual case in which a psychiatrist was called in to assess a patient’s capacity to refuse treatment, the aim of this study is to discuss how to manage this ethical and clinical issue and the dilemmas faced by the medical team.Case presentation: The case involved a 45-year-old female patient diagnosed with breast cancer who refused treatment. Since the mastology team had doubts about the patient’s mental state and given that she refused to consent to surgery, a forensic (...) psychiatric consult was requested.ConclusionThe forensic psychiatry team concluded that the patient’s decision-making capacity was preserved. The team suggested some actions to help the specialists deal with the ethical conflict. DIREITO DO CONSUMIDOR E A RESPONSABILIZAÇÃO POR PUBLICIDADE ENGANOSA E ABUSIVA: ANÁLISE DO CASO DO CONTRATO DE FORNECIMENTO DE INTERNET MÓVEL ILIMITADO POR EMPRESAS DE TELEFONIA MÓVEL.

Os objetivos do presente estudo foram: realizar uma série histórica dos procedimentos realizados pelos serviços odontológicos na Atenção Primária em Saúde (APS) no município de Canoas e verificar a redução da proporção de procedimentos de exodontia. Os dados foram coletados do Departamento de Informática do SUS (DATASUS) e foram agrupados em blocos de procedimentos odontológicos: exodontias, restauradores, preventivos, periodontais, endodônticos/urgências e outros procedimentos. Verificou-se que houve redução da proporção de exodontias e quando foram calculadas as médias do período de 10 (...) anos, utilizando os critérios específicos da APS e do IDSUS, as proporções de exodontias foram 4,46% e 4,83%. Neste contexto, conclui-se que a série histórica evidencia a redução das proporções de exodontias no município e as médias das proporções das exodontias no período avaliado foram maiores quando comparadas com a meta estabelecida pelo Plano Anual de Saúde (2,8). This article investigates if and how negotiators' self-efficacy beliefs affect their use of deception in negotiation. Specifically, we propose that self-efficacy can be interpreted as a threat to self-concept, which encourages individuals to temporarily bypass self-regulatory obstacles by morally disengaging their cognitive moral filters, thereby enabling them to use deception in negotiation. We test our hypotheses in three independent experimental studies involving an interactive negotiation simulation, totalizing 460 participants. We find that negotiators with low self-efficacy regarding their negotiation abilities are (...) more likely to use deception than those with high self-efficacy beliefs. Furthermore, we find that moral disengagement mediates the effects of self-efficacy on deception. Our findings suggest that self-efficacy plays a key role in shaping negotiators' ethical behaviors and we identify the psychological mechanism underlying this relationship. (shrink)

O foco deste artigo é analisar as antropologias históricas dos historiadores Reinhart Koselleck e Jörn Rüsen, com o objetivo de pontuar as similaridades e as diferenças entre elas. Para tal, partimos do significado que Koselleck atribui à teoria da história, entendida por ele como teoria das “condições de possibilidade da história”, tendo como objeto de estudo aquilo que é comum a toda experiência histórica, que a estrutura e a torna possível. Assim, Koselleck trabalhou a partir de pares de categorias antropológicas, (...) ou universais, tais como ter de morrer/poder matar e interno/externo. Rüsen também fez algumas análises a partir do uso de pares antropológicos. A partir da análise e comparação das teorias destes dois historiadores chegamos à tese de que Koselleck constrói uma antropologia histórica baseada no “conflito”, enquanto a de Rüsen é calcada na noção de “humanidade”, sendo esta uma grande diferença epistemológica entre os autores. Soccer players inescapably live under stress during the sportive career, and many real-life aspects of soccer situations operate in the ongoing performance. This study’s main objective was to elaborate the List of Stressors in Professional Indoor and Field Soccer, a self-report instrument designed to measure the impact of 77 soccer situations upon the sport performance. Participants were 138 indoor and field soccer players from the Brazilian Premier League. Each situation was evaluated on a 7-point scale, ranging from the most negative (...) to the most positive. Data were analyzed according to the players’ perception of the items: distress or eustress and its intensity, and after that, situations perceived as plus −1 and +1 were compared by time in which they were experienced and distributed among five categories established by the literature: Expectations about the Performance, Personal Factors, Competition Aspects, Training Demands, and Relationship with Significant People. Narratives of athletes’ experiences were also used to discuss the results. An Exploratory Structural Equation Modeling using Bi-factorial was employed to assess the factor structure. For the total participants, 49 situations were perceived as distress and 28 as eustress. Using the criteria established a priori, the distribution was among the five categories in the remaining 32 situations. Differences in perception between less and more experienced players were found in 11 situations. The results revealed that Brazilian professional soccer players experience various stressful situations. These events are important representations of environmental demands and could predict the performance as they are perceived as eustress or distress. Some of these stressful situations are inherent in sport and others adjacent to the sports system or environment. Coach pressure to win and conflicts with teammates are examples of stressors in-sport, family problems and disputes with press or fans are examples of stressors external to the team, also called peripheral opponents, and showed the relative social influence of significant others in soccer performance. We can conclude that the knowledge of the direction of a given stress situation has important practical implications in preparing athletes and helping them face the performance stressors that are part of soccer daily life. Este trabajo investiga las interrelaciones entre la regulación y los as-pectos económicos y ambientales en una comunidad de agricultores familiares en la región conocida como Zona da Mata Mineira, en el estado brasileño de Minas Gerais. El estudio es producto de una acti-vidad de extensión realizada entre 2016 y 2018, y tuvo como objetivo asesorar a los pequeños productores en el proceso de adecuación legal de la producción. Durante este período se realizaron cerca de cinco reuniones entre investigadores y comuneros, (...) en las que se analizaron las dificultades encontradas por los pequeños productores en relación con el referido proceso. Las experiencias reportadas fueron confron-tadas con el régimen legal regulatorio para la actividad acuícola en Brasil, tomando como categorías de análisis los atributos de norma-tividad y facticidad del sistema legal. Se concluyó que la regulación ambiental en el área de la acuicultura en Brasil, diseñada para grandes productores, carga de manera desproporcionada a los pequeños pro-ductores, generando un desequilibrio económico injustificado. Como aporte a la teoría, se propone, en definitiva, la formulación de un con-cepto de regulación jurídica inclusiva, cuyos rasgos distintivos inclu-yen la participación social y la promoción de la alfabetización jurídica como derecho fundamental. O objetivo deste artigo é analisar a ética do cuidado de enfermagem no tratamento de pacientes oncológicos. Optou-se pela pesquisa bibliográfica de abordagem qualitativa cuja metodologia foi dividida em etapas. Na primeira etapa, foi realizado um levantamento de artigos publicados, no período de 2000 a 2009, em periódicos do Scielo, utilizando os descritores: saúde/doença, enfermagem, ética do cuidado e oncologia. Esse levantamento culminou com a seleção de 28 artigos, 21 dos quais foram eleitos posteriormente para leitura aprofundada, assim como para (...) utilização no estudo. Na segunda etapa, foram explorados dados do campo, com a transcrição e análise de depoimentos de profissionais da enfermagem sobre a concepção de cuidado bem como de dados sobre pacientes oncológicos, acompanhados no período de 2007 e 2008. A pesquisa e suas exigências protocolares, sob o número CAAE - 0147.0.213.000-10, foi aprovada pelo Comitê de Ética da PUC Minas em 31 de agosto de 2010. O referencial teórico foi composto por autores que discutem o cuidado na perspectiva filosófica e teológica - Boff (2001, 2005 e 2006), Efken (2005) - e autores da área da saúde oncológica, entre eles, Carvalho et al. (2002), Popim & Boemer (2005), Visentin, Labronici & Lenardt (2007) e Araújo et al. (2009). Os resultados evidenciaram o cuidado na enfermagem como princípio ético essencial, assim como a necessidade de investimentos em políticas públicas de saúde no Brasil, que efetivem o trabalho de prevenção, educação e cura do câncer. We have opted for bibliographical research of qualitative nature, a methodology divided into stages. In the first stage we gathered articles in a publication called Scielo from 2000 to 2009, which described: health/illness, nursing, ethics of care, and oncology. Through this process the selection of twenty-eight articles was accomplished, however only twenty-one articles were utilized in the production of this study. In the second stage field data were explored, we transcribed and analyzed the statements of nursing professionals on the conception of care and on oncology patients overseen by them in the period of 2007 to 2008. The research protocol and its requirements under the number CAAE - 0147.0.213.000-10, was approved by the Ethics Committee of PUC Minas on August 31, 2010. The theoretical support was provided by authors who discuss care in a philosophical and theological perspective: Boff (2001, 2005, and 2006), Efken (2005); and authors in the field of healthcare, among them Popim & Boemer (2005), Silva et. al , (2005), Souza et al. (2005), Visentin, et al. (2007), and Araújo, et. al. (2008). The results demonstrated the care in nursing as an essential ethical principal, as much as the necessity of investment in public health policies in Brazil, for the effective promotion of cancer prevention, education and cure. This article investigates the existence of an original Brazilian legal culture. It parts from a critical examination of the key moments in the history of Brazil through the accounts of its most important scholars, such as Caio Prado Júnior, Darcy Ribeiro, Sérgio Buarque de Holanda, Wilson Martins, Oliveira Viana, Roberto Damatta, José Murilo de Carvalho, among others. It identifies in the Brazilian legal culture something one might call tradition of exception, which can be found in many of its most (...) prominent aspects, such as the persistent denial of any general or abstract regulatory standards, the uncritical introduction of foreign doctrines and legal patterns, the maintenance of aristocratic traditions in social life and the historical disregard of the Brazilian people as political subject. The article also offers a reflection on the problems and potentials of the current historic moment, in which for the first time Brazilians face the possibility of a genuine cultural emancipation. There are communities in which disadvantaged groups experience severe inequality. For instance, poor and indigent families face many difficulties accessing their social rights. Their condition is largely the consequence of the wrong choices of those in power, either historical or more recent choices. The lack of opportunities of these deprived citizens is due to state omissions. In such communities, it is not unusual for homeless members of these particular groups to occupy abandoned lands and build their shelters there. However, almost (...) everywhere, these actions constitute a crime. The typical response to this situation is prosecution and punishment. In this paper, I will defend the occupation of public places as a consequence of the failure of governments to solve the problem of housing, and I will argue that we must distinguish a social claim from a crime and avoid the use of criminal law in these “occupation cases”. I will also argue that our right—as a community—to blame and punish these “squatters” is eroded by the fact that we perpetrated their situation of injustice. (shrink)

Dung’s argumentation frameworks have been applied for over twenty years to the analysis of argument justification. This representation focuses on arguments and the attacks among them, abstracting away from other features like the internal structure of arguments, the nature of utterers, the specifics of the attack relation, etc. The model is highly attractive because it reduces most of the complexities involved in argumentation processes. It can be applied to different settings, like the argument evaluation of an individual agent or the (...) case of dialectic disputes between two agents (pro and con), or even in multi-agent collective argumentation. The latter case involves agents with possibly different arguments and/or opinions on how to evaluate them, leading to the possibility of considering multiple sets of arguments and attack relations. Two basic questions can be asked here, namely ‘what to aggregate’ and ‘how to aggregate’. The former concerns what kinds of entities do the agents intend to choose (arguments, attacks, assessments, etc.), while the second one focuses on which aggregation mechanisms yield rational choices (voting on arguments, merging procedures to obtain a common argumentation framework, deliberation processes, etc.). In particular, the question about the rationality of a collective argument choice relates this topic to Social Choice and Judgment Aggregation theories, while its associated strategic issues relate it to Game Theory. The research efforts on the disparate problems elicited by collective argumentation have generated a considerable corpus of literature that deserves an orderly evaluation. The problems that arise from the presence of self-attacking ar- guments and odd-length cycles of attack within argumentation frameworks are widely recognized in the literature on defeasible argumentation. This paper introduces two simple semantics to capture different intuitions about what kinds of arguments should become justified in such scenarios. These semantics are modeled upon two extensions of argumentation frameworks, which we call sustainable and tolerant. Each one is constructed on the common ground of the powerful concept of admissibility introduced by (...) Dung in [10]. The novelty of this approach consists in viewing the admissibility of a subset of arguments as relative to potentially challenging subsets of arguments. Both sustainable and tolerant semantics are more credulous than preferred semantics (i.e. they justify at least the same arguments, and possibly more). Given certain sufficient conditions they coincide among them as well as with other semantics introduced by Dung. (shrink)

In this paper we provide a compact presentation of the verisimilitudinarian approach to scientific progress (VS, for short) and defend it against the sustained attack recently mounted by Alexander Bird (2007). Advocated by such authors as Ilkka Niiniluoto and Theo Kuipers, VS is the view that progress can be explained in terms of the increasing verisimilitude (or, equivalently, truthlikeness, or approximation to the truth) of scientific theories. According to Bird, VS overlooks the central issue of the appropriate grounding of scientific (...) beliefs in the evidence, and it is therefore unable (a) to reconstruct in a satisfactory way some hypothetical cases of scientific progress, and (b) to provide an explanation of the aversion to falsity that characterizes scientific practice. We rebut both of these criticisms and argue that they reveal a misunderstanding of some key concepts underlying VS. (shrink)

This book throws new light on the way in which the Internet impacts on democracy. Based on Jürgen Habermas' discourse-theoretical reconstruction of democracy, it examines one of the world's largest, most diverse but also most unequal democracies, Brazil, in terms of the broad social and legal effects the internet has had. Focusing on the Brazilian constitutional evolution, the book examines how the Internet might impact on the legitimacy of a democratic order and if, and how, it might yield opportunities for (...) democratic empowerment. The book also assesses the ways in which law, as an institution and a system, reacts to the changes and challenges brought about by the Internet: the ways in which law may retain its strength as an integrative force, avoiding a 'virtual' legitimacy crisis. ABSTRACTContrary to what some critics of epistemic democracy claim, the association between democracy and truth does not necessarily make the former inhospitable to conflict, contestation, and pluralism. With the help of John Stuart Mill and William James, truth can be interpreted so as to make it compatible with a democratic politics that appreciates conflict and dissent. In some circumstances, truth claims are politically relevant and should become the object of democratic deliberation.

O artigo busca elaborar um conceito de liberdade democrática como desenvolvimento de si, resistência à opressão e à injustiça epistêmica mediante engajamento crítico com as obras de Paulo Freire, Amílcar Cabral e Augusto Boal. No pensamento dos três autores, democracia, liberdade e desenvolvimento de si constituem uma tríade de mútua influência, de sorte que o pleno exercício de quaisquer desses itens é impossível na ausência de qualquer um dos outros dois. Trata-se de mostrar, além disso, a maneira pela qual a (...) opressão é compreendida nos trabalhos dos três pensadores como o oposto da liberdade, e a injustiça epistêmica, como uma dimensão psíquica da opressão. Theory change is a central concern in contemporary epistemology and philosophy of science. In this paper, we investigate the relationships between two ongoing research programs providing formal treatments of theory change: the (post-Popperian) approach to verisimilitude and the AGM theory of belief change. We show that appropriately construed accounts emerging from those two lines of epistemological research do yield convergences relative to a specified kind of theories, here labeled “conjunctive”. In this domain, a set of plausible conditions are identified which (...) demonstrably capture the verisimilitudinarian effectiveness of AGM belief change, i.e., its effectiveness in tracking truth approximation. Ao longo da trajetória intelectual de Merleau-Ponty, as reflexões sobre arte cumprem um papel crucial em sua preocupação de restituir o espetáculo do mundo, através da volta ao brotamento do sentido do ser na experiência antepredicativa do ser humano dada na percepção. Um sinal disso é que, em cada um dos momentos de seu pensamento, ele escreveu um ensaio no qual o tema central é a contribuição da expressão artística para uma reflexão filosófica interessada na abertura humana corporal no mundo. Este artigo tem como propósito realizar uma aproximação de tais ensaios – recorrendo a uma abordagem cronológica – com vistas a demarcar como eles auxiliam no reconhecimento de certas nuances e articulações de seu pensamento, enfatizando a constante ontológica presente em suas discussões sobre arte. Assim, o trabalho realiza uma visão horizontal sobre o percurso merleau-pontiano de pensamento – transitando da fenomenologia da percepção à ontologia da carne –, com incursões verticais sobre as relações entre percepção, expressão e instituição nos ensaios. The body of Eva in Thomas Aquinas The constitution of the first female body or the body of Eva presents several physical and metaphysical problems, problems that have gone through the centuries and reach the present, generating social and cultural consequences for women. The non-existence of parents demands from Aquino answers that go beyond the anthropological and biological and lead to the search of philosophical answers intertwined with the theological ones. Thomas Aquinas provides rational answers although the background is of (...) faith, and even, with literal interpretations of the Sacred Scriptures now abandoned. The Aquinate makes an intellectual effort to find answers in a rational field because the matter of the body of the first woman brings difficulties for its elucidation and understanding. As in other parts of his extensive work, Thomas Aquinas, follows the biological and physical works of Aristotle. Although the Aristotelian background is in line with Christian thought, Aquinas shows his extraordinary capacity for synthesis between the faith received and reason argued, between revelation and the principles of reason. Micro Credit (MC) programs lend money to poor borrowers using innovative mechanisms such as group lending under joint liability while successfully accounting for the presence of asymmetric information in underdeveloped financial markets. MC programs have achieved what the conventional financial institutions and the government have not been able to: lend to the poor, impressive loan recuperation, and a positive impact in poverty reduction. This article analyzes the performance of ALSOL, an MC program in Chiapas, México, for 2151 participants in urban (...) and rural areas for the time period between July 2000 and July 2001. While loan recuperation is high (95%), administrative costs also remain high. Socially responsible lenders and donors play a key role in providing continuous funding to MC programs and assisting in reducing the level of poverty. (shrink)

This paper questions the notion that states may be justified in denying certain prisoners the right to vote as a means of distancing themselves from particularly grave wrongs. Christopher Bennett has recently defended prisoner disenfranchisement as a fair and deserved retributive punishment for crimes, and Mary Sigler and Andrew Altman have argued in favor of prisoner disenfranchisement as a civil restriction. All three proponents agree that disenfranchisement should be reserved for those guilty of the most serious offenses. I assert that (...) it is inappropriate to treat citizens in this manner and will advocate for the right to vote, whether disenfranchisement is perceived as a form of punishment or as a civil measure. I will present two arguments against disenfranchisement as it impacts both citizens and political community at large. First, it excludes citizens from the democratic arena and restricts the opportunity to reintegrate offenders into the political community. While a criminal sentence is intended to be burdensome, the burden associated with disenfranchisement extends beyond the appropriate penal scope. (shrink)

Con ese propósito, el jurista identifica los diferentes modelos de readaptación social (“readaptación para la moralidad” y “readaptación para la legalidad”), con sus virtudes y críticas. Por último, Arocena examina los condicionamientos que impone un arquetipo de Estado social y democrático de Derecho, a la hora de adherir a uno u otro de esos modelos, y (...) finalmente expone sus razones a favor de un paradigma de readaptación social mínimo. O texto que ora apresentamos é o conteúdo de uma Palestra proferida em Agosto de 2011, em Lisboa, e discute alguns pareceres de Hegel sobre o ensino da filosofia na Universidade, e especilamente nos Liceus. Nosso objetivo é discorrer sobre as três fundamentais “lições” que se pode inferir das meditações hegelianas acerca do ensino da filosofia, a saber: 1) o professor tem que pensar; 2) a filosofia (e o filosofar) não é tão-somente um mero formalismo; 3) a dialéctica se configura (...) como textura, conteúdo, do real e como ocupação nuclear de uma penetração pensante do ser. Primeiramente, nossa argumentação evidencia que, para Hegel, o professor tem que pensar porque este ato é uma exigência fundante do seu trabalho docente de formação. No segundo momento, demonstramos que Hegel se posiciona contrário à tese que afirma o formalismo na contraposição filosofia versus filosofar. Em terceiro lugar, expomos que, para Hegel, o ensino e a aprendizagem devem se ocupar, necessariamente, da dialéctica, na medida em que esta não é um mero instrumento da técnica pedagógica, mas porque ela é constitutiva do pensar e da manifestação do ser no mundo. Dung’s argumentation frameworks are formalisms widely used to model interaction among arguments. Although their study has been profusely developed in the field of Artificial Intelligence, it is not common to see its treatment among those less connected to computer science within the logical-philosophical community. In this paper we propose to bring to that audience a proof-theory for argument justification based on tableaux, very similar to those the Logic students are familiar with. The tableaux enable to calculate whether an argument or (...) subset of arguments are accepted or rejected in accordance to Dung’s preferred and grounded extension-based semantics. Soundness and completeness results regarding those semantics are provided. (shrink)

Following that is a summary of his more recent reactions to scientific discoveries in physics and a discussion of his position about non-locality in quantum mechanics, as well as his changing opinions on the nature of spacetime. Este artigo tem como objetivo principal investigar a relação existente entre a percepção da felicidade dos brasileiros, sua satisfação com a vida e a satisfação com o regime democrático no período de 2017 a 2020. Nossa hipótese de trabalho postula que o declínio da felicidade e da satisfação com a vida, de uma forma geral, guarda relação de associação com a satisfação com a democracia e suas instituições. Assim, o artigo sugere que felicidade e democracia no Brasil são duas variáveis (...) associadas que ajudam a explicar em parte as fragilidades de nosso regime democrático e devem ser foco de atenção de nossas políticas públicas. A base empírica deste artigo é a sétima onda da Pesquisa Mundial de Valores (WVS, 2017-2020), por meio de pesquisa quantitativa, tipo survey, que utilizaremos para demonstrar nosso argumento. In this paper, we address the problem of truth approximation through theory change, asking whether revising our theories by newly acquired data leads us closer to the truth about a given domain. More particularly, we focus on “nomic conjunctive theories”, i.e., theories expressed as conjunctions of logically independent statements concerning the physical or, more generally, nomic possibilities and impossibilities of the domain under inquiry. We define both a comparative and a quantitative notion of the verisimilitude of such theories, and identify (...) suitable conditions concerning the (partial) correctness of acquired data, under which revising our theories by data leads us closer to “the nomic truth”, construed as the target of scientific inquiry. Compreender a violência na sociedade contemporânea requer o mapeamento dos fatores geradores de atos violentos bem como sua prevenção por meio de políticas públicas e de processos educacionais. Este artigo traz algumas reflexões sobre a racionalidade comunicativa e a violência escolar no contexto da crescente exclusão social e a crise de horizontes utópicos para a construção da educação e da formação de sujeitos de direitos. A abordagem metodológica está ancorada na perspectiva da análise de conteúdo de Laurence Bardin (2016), do (...) documento ‘Violência escolar e bullying: relatório sobre a situação mundial’, publicado pela Organização das Nações Unidas para a Educação, a Ciência e a Cultura (UNESCO). São analisadas as pretensões de validade das informações e dos dados considerados relevantes por meio da elaboração de dois eixos principais para analisar a violência escolar apresentada no relatório: a) definições e amparos legais; b) impactos e principais desafios sobre a violência escolar e o bullying. Nessa perspectiva, recorreremos à Racionalidade Comunicativa, ponto central da Teoria do Agir Comunicativo, de Jürgen Habermas, para refletir sobre os achados e saber quais as bases consideradas relevantes para se construir uma educação para a paz alicerçada no diálogo e no entendimento. The ethics of autonomous vehicles has received a great amount of attention in recent years, specifically in regard to their decisional policies in accident situations in which human harm is a likely consequence. Starting from the assumption that human harm is unavoidable, many authors have developed differing accounts of what morality requires in these situations. In this article, a strategy for AV decision-making is proposed, the Ethical Valence Theory, which paints AV decision-making as a type of claim mitigation: different road (...) users hold different moral claims on the vehicle’s behavior, and the vehicle must mitigate these claims as it makes decisions about its environment. Using the context of autonomous vehicles, the harm produced by an action and the uncertainties connected to it are quantified and accounted for through deliberation, resulting in an ethical implementation coherent with reality. The goal of this approach is not to define how moral theory requires vehicles to behave, but rather to provide a computational approach that is flexible enough to accommodate a number of ‘moral positions’ concerning what morality demands and what road users may expect, offering an evaluation tool for the social acceptability of an autonomous vehicle’s ethical decision making. Apresentaremos as possíveis aplicações pedagógicas das suas reflexões, como a utilização da imprecisão científica de Heisenberg e da concepção de técnica em Heidegger, a partir da análise histórico-filosófica dos seus escritos, tomando-os como fundamentação a necessária e significativa melhoria da educação técnico-científica.

ABSTRACT In the 1960s, when Dr. Belding Scribner discovered how to accomplish the process of dialysis in a repeated way, he could not imagine that in solving such a problem others as or more difficult would appear. Given the technological progress and the impossibility of assisting all patients through the most modern methods, the medical doctor often finds himself faced with the moral dilemma of choosing which patient in the waiting list will receive the treatment. This same dilemma is amplified (...) in the case of organ transplants. Professionals, students, professors of the juridical and health fields, and the population in general, were interviewed as a means of documenting the moral concepts and opinions surrounding this problem. In the reality in which we find ourselves, it seems to us that deciding who lives, and the responsibility for all the events that culminate in such decisions, is still a subject left open to discussion. O acontecimento do compreender, enquanto questão-chave do pensamento de Gadamer, também pode ser compreendido como uma fusão de horizontes. Do ponto de vista da hermenêutica filosófica, tal aspecto abre a possibilidade de tematização do âmbito próprio da compreensão como uma experiência filosófica simultaneamente ontológica e prática. Por isso, a descrição do compreender enquanto fusão de horizontes indica o tratamento de traços fundamentais da vida humana que, para Gadamer, encontra afinidades com a retomada da filosofia prática de Aristóteles. Deste modo, pretendemos (...) discutir alguns aspectos da relação entre os conceitos de compreensão e fusão de horizonte a partir da conexão essencial entre hermenêutica filosófica e filosofia prática.: The happening of understanding, as key-issue of Gadamer’s thought, can be also understood like a fusion of horizons. From the point of view of philosophical hermeneutics, this aspect opens the possibility of discussing about the sphere of understanding simultaneously ontological and practice philosophical experience. Therefore, the description of understanding as fusion of horizons indicates the treatment of basic traces of human life that finds affinities with the rehabilitation of practical philosophy of Aristotle. Thus, we intend to discuss some aspects of the relation between the notions of understanding and fusion of horizons from the essential connection between philosophical hermeneutics and practical philosophy. Na abordagem hermenêutica das obras de arte, Gadamer discute a arquitetura como uma das expressões artísticas na qual se pode reconsiderar a relação ontológico-interpretativa com as coisas em geral. Repensando a estrutura representativa própria da experiência hermenêutica das obras de arte, Gadamer introduz a arquitetura como uma expressão artística peculiar, na qual as obras de arte resistem aos posicionamentos estéticos atuais, reinserindo-as na esfera prática da vida. Essa tematização encontra ecos importantes na teoria e prática arquitetônicas, à medida que possibilita (...) uma nova relação com as obras de arquitetura, para além das variáveis estéticas. O presente artigo, portanto, tem como objetivo discutir a experiência hermenêutica da arquitetura como um momento interpretativo decisivo da relação com as obras de arte, explicitando tanto o caráter ontológico-hermenêutico do pensamento de Gadamer quanto o traço hermenêutico das obras de arquitetura. Para isso, partimos de um diálogo estabelecido por Gadamer e dois arquitetos, Jacques Herzog e Pierre de Meuron sobre a essência da arquitetura. A resposta gadameriana indicou-nos o horizonte de tematização das obras arquitetônicas como extensão da experiência da obra de arte, tal como foi discutido em Verdade e Método, notadamente na discussão sobre a representação artística e a retomada das noções de ocasional e decorativo. A tematização hermenêutica encontra, por conseguinte, repercussões na teoria e prática arquitetônicas, indicando um horizonte alternativo de questionamento do sentido da arquitetura e urbanismo, situando-o e remetendo-o para o horizonte da vida em comum. A covid-19 tem gerado grande mobilização por parte das sociedades contemporâneas. Como forma de prevenção e controle da doença, o isolamento social tem sido uma medida eficaz, recomendada por diversos órgãos da saúde. Por isso, pensar o isolamento social como prática solidária tem sido fundamental. Nesta perspectiva, o presente artigo busca problematizar o isolamento social enquanto isolamento solidário. Para isso, partimos da tematização da enfermidade, até agora conhecida, seus modos de prevenção e controle e, por conseguinte, o diálogo entre a (...) Saúde Coletiva e a Hermenêutica Filosófica, na tentativa de repensar o isolamento criticamente, para além de uma questão biomédica. Assim, discutir o isolamento solidário como noção essencial ao enfrentamento da pandemia da COVID-19 significa contribuir para uma visão mais ampla de saúde, ao passo que se encontra em jogo o restabelecimento da vida comunitária para além de sua concepção biomédica. Primeiramente fazemos uma breve discussão sobre a concepção defendida por Gramsci acerca do que caracteriza um intelectual, bem como sua função social nas distintas formações sociais, como desdobramento de tal reflexão do autor sardo, apresentamos sua conhecida distinção, operada no “Caderno 12”, entre os „intelectuais tradicionais‟ e os „intelectuais orgânicos‟ destacando sua práxis social. Por fim, valendo-nos dos escritos do autor no “Caderno 13”, ressaltamos a importância do intelectual orgânico na constituição do partido revolucionário.First we give a brief discussion about (...) the concept advocated by Gramsci about what characterizes an intellectual as well as its social function in different social formations, as a consequence of such a reflection of the author Sardinian, presented his famous distinction, operated in the "Notebook 12" between the 'traditional intellectuals' and 'organic intellectuals' highlighting its social praxis. We generalize a previous result about dynamically consistent menu preferences to the case where preferences are not necessarily complete. We show that, as it is the case when preferences are complete, a subjective state space version of dynamic consistency is linked to a comparative theory of preference for flexibility. In words, an objective signal is interpreted as an event in the agent’s subjective state space and the agent acts in a dynamically consistent way after that if and only if we (...) can attribute all the differences between the agent’s preferences before and after the signal to the fact that the agent values flexibility more before the signal than after. We present the system SUBSEXPL used for simulating and comparing explicit substitutions calculi. The system allows the manipulation of expressions of the λ-calculus and of three different styles of explicit substitutions: the λσ, the λse and the suspension calculus. A variation of the suspension calculus, which allows for combination of steps of β-contraction is included too. Implementations of the η-reduction are provided for each style. Other explicit substitutions calculi can be easily incorporated into the system due to its modular structure. (...) The uses of the system include: the visualization of the contractions of the λ-calculus in de Bruijn notation, and of guided one-step reductions as well as normalization via each of the associated substitution calculi. Many useful facilities are included: reductions can be easily recorded as text files, LATEX outputs can be generated and several examples for dealing with arithmetic operations and computational operators such as conditionals and repetitions in the λ-calculus are available. The system can be executed over Emacs using the x-symbol mode in such a way that λ-terms and terms of the explicit substitutions calculi are represented in its natural syntax avoiding the necessity of repeatedly generating LATEX outputs. The system has been of great help for systematically comparing explicit substitutions calculi, as well as for understanding properties of explicit substitutions such as the Preservation of Strong Normalization. In addition, it has been used for teaching basic properties of the λ-calculus such as: computational adequacy, the usefulness of de Bruijn's notation and of making explicit substitutions in real implementations. This article proposes a reflection on the persistence of Nazi jurisdictional models in contemporary legal theory, briefly comparing the work of authors such as Wolf, Larenz, Schmitt, Dworkin and Alexy. It aims to demonstrate the authoritarian and radically undemocratic character of certain theoretical constructions used in adjudication, particularly in Brazil. For this purpose, three representative judicial decisions from 2016 are analyzed, highlighting typical structural features of Nazi legal theory which remain accepted by current legal theory, such as the disregard for (...) legality, the personification of the community as judge and the appeal to social values which are taken as self-evident. Conceptual engineering is commonly characterized as the method for assessing and improving our representational devices. Little has been said, however, on how best to construe these representational devices—in other words, on what conceptual engineering should be all about. This paper tackles this problem with a basic strategy: First, by presenting a taxonomy of the different possible subject matters for conceptual engineering; then, by comparatively assessing them and selecting the most conducive one with a view to making conceptual engineering an actionable (...) method, that is, a method that can be applied effectively and consistently to specific case studies. The outcome is that conceptual engineering should be all about concepts on pain of pragmatic inconsistencies otherwise. (shrink)
